It is only recently that any act of sexual penetration regardless of its nature is condidered as RAPE by law : law dated 23.12.80, Article 332. Later, the notion of RAPE between spouses as well as the introduction of a foreign body was recognized. In 1994, in the new civil code, the penalties for such acts have been increased. The number of sexual delinquency inmates is thus increasing in prisons. Who are they ? What is to be done with them ? In 1993, under the patronage of the Ministries of Health and of justice, we prepared a questionnaire for those assumed to be sexual delinquents. The questionnaire were distributed in Automn 1994. The research was carried out mainly by the Régional Médico-Psychological Services. The INSERM is now processing the data but a clinical draft report is to be published. Indeed, the sexual act is considered to be within the sexual domain and this could mislead us to think that it is only abnormal sexuality. In fact, it seems that the génitals are only an instrument that make it possible to overcome the fear of loss of identity. But, why such a choice, how can we listen, understand, may be change it.
